Eligibility: This Giveaway is sponsored by Liberation Entertainment, Inc. ("Sponsor"). It is open to all internet entrants 18 years of age or older, except where prohibited by law, during the specified Giveaway time period, with Internet access prior to the start date and time of the Giveaway. Employees, officers, and directors of Sponsor and its parent, affiliated, and subsidiary companies, distributors, retailers, licensors, advertising and promotional agencies (and the immediate family members, including parents, spouses, children, and siblings, of all of the foregoing) are not eligible to or win.

To Enter: During the specified Giveaway period you may enter by filling out the Daniel Boone in '08 Giveaway Entry Form at http://www.boonein08.com. Limit one entry per person, household, IP address and/or email address. Entries will be deemed to have been submitted and made by the authorized account holder of the email address at the time of entry. The authorized account holder is the individual who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning such email addresses for its associated domain name (“User”). False, fraudulent, or deceptive entries or acts will render entrant(s) and entries ineligible.

Winner: The Winner(s) will be notified by e-mail and will be required to respond within three (3) days of notice to claim their prize. The Winner(s) may be required to complete, sign, and return to Sponsor an affidavit of eligibility, a waiver of liability, and (where legally permitted) a publicity release , or prize may be forfeited and offered to an alternate winner. By entering the Giveaway, entrants consent to the use by Sponsor of their name, voice and likeness in advertising, promotional materials, and on its website, throughout the universe in perpetuity.

Prizes: Odds of winning a prize are determined by total number of eligible entries received. Limit one prize per person, household, IP address, and/or email address. Sponsor during any Giveaway. All taxes are the responsibility of the winner. All prizes are non-transferable, with no cash redemptions and/or substitutions except at Sponsor’s sole discretion. All international winners will be responsible for any duties, tariffs, taxes or import fees assessed to their prize. This fee will need to be paid prior to shipment of any prizes. Please be prepared to provide us with a payment method. Further, some countries outside of the U.S. do not have reliable mail services. In the event that a prize has been stolen or mishandled during shipment to an international destination, Sponsor may not be able to replace the specific item(s).

Terms of Participation: This Giveaway is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of www.boonein08.com constitutes your agreement to all such terms, conditions, and notices.

User Privacy: User agrees to provide personal information for the sole purpose of becoming an entrant into the Giveaway by Sponsor/www.boonein08.com. Neither Sponsor nor www.boonein08.com will share, collect, survey or question your interest or participation in www.boonein08.com for any other reason than your desire to win free prizes or receive promotional email offers (on an opt-in or subscription basis).

WEBSITE CONTENTS: The contents of www.boonein08.com (including without limitation all database information), and all elements that are a part of the foregoing, and all intellectual and other proprietary rights therein, are the property of Sponsor. You will not use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, or intelligent agents) to navigate or search www.boonein08.com other than the search engine, search agents, and email notifications available from www.boonein08.com or Sponsor and other generally available third-party web browsers. You will not attempt to violate the security of www.boonein08.com by any means. You agree to indemnify Sponsor and www.boonein08.com, their officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your provision of any material to www.boonein08.com (including but not limited to claims of breach of third-party intellectual property rights) or from your breach of this agreement.

Except as may arise under the immediately preceding paragraph, neither party will be liable to the other party (nor any person claiming rights derived from the other party's rights) for incidental, indirect, consequential, special, punitive or exemplary damages of any kind.
USE OF COMMUNICATION SERVICES: The Sponsor and www.boonein08.com web sites may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with other entrants (aka "sweepers") or with a group (collectively, Communication Services). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Restrict or inhibit any other user from using and enjoying the Communication Services.
Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
Violate any applicable laws or regulations.

Sponsor and www.boonein08.com reserve the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Sponsor and www.boonein08.com reserve the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Sponsor and www.boonein08.com reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Sponsor’s and www.boonein08.com's sole discretion.

LINKS TO THIRD PARTY SITES: Sponsor and www.boonein08.com web site(s) may contain links to other web sites (aka Link Partners). Link Partners are not under the control of Sponsor or www.boonein08.com and neither Sponsor nor www.boonein08.com shall be responsible for the contents of any Link Partner site, including without limitation any link contained in a Link Partner site, or any changes or updates to a Link Partner site. Neither Sponsor nor www.boonein08.com shall be responsible for web casting or any other form of transmission received from any Link Partner site. Sponsor and www.boonein08.com is providing these links to you only as a convenience only.

GENERAL: By digitally signing this agreement to enter the Giveaway you hereby agree to abide by such terms of use, as Sponsor may amend them from time to time in its discretion. This agreement (i) constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes any previous oral or written agreements or understandings relating thereto (ii) shall be governed by the laws of the State of California (including the conflicts of laws provisions thereof), (iii) may not be amended, terminated or waived without the written consent of Sponsor, and (iv) may not be assigned, in whole in or in part, directly or indirectly by you. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the User, Sponsor and www.boonein08.com with respect to the Giveaway.
